The Management of Health and Safety at Work Regulations - Reg 7 (1999) Health & Safety Assistance requires employers to
"Appoint one or more competent people to help them in undertaking the measures they need to take to comply with the requirements imposed on them by or under the relevant statutory provisions."
The “competent” person must have time and resources available to fulfil their function and be provided with the necessary information.
